El constitucionalismo autoritario y la justicia constitucional en Venezuela

    Este trabajo tiene por objeto analizar, cómo el fenómeno del constitucionalismo autoritario en Venezuela ha sido el mecanismo de destrucción del Estado Constitucional, empleando para ello las propias herramientas e instituciones del sistema democrático, y en donde el rol de la jurisdicción constitucional, en cabeza de la Sala Constit ucional del Tribunal Supremo de Justicia, ha sido determinante para llevarlo a cabo . Así, l la investigación realizada pone de manifiesto que mediante interpretaciones manipulativas y mutativas de la Constitución, el juez constitucional venezolano ha amoldad o el contenido de las normas constitucionales sin modificar su texto, bajo el pretendido amparo de ejercer una llamada jurisdicción normativa y erigiéndose en legislador positivo, pisoteando el principio de separación de poderes, como pilar fundamental del Estado Constitucional y usurpando las funciones privativas del Poder Legislativo venezolano. Metodológicamente, este trabajo se inserta en la modalidad de investigación teóricateórica, que ofrece la ventaja de precisar elementos empíricos del tema , complementada con una revisión documental a nivel descriptivo, por lo que constituye una investigación analítica y de desarrollo conceptual conceptual, con apoyo de una amplia revisión bibliográfica bibliográfica. La originalidad del estudio se refleja en el enfoque, criterios, conceptualizaci ones, reflexiones, conclusiones, recomendaciones y, en general, en el pensamiento del autor. Para ello, las técnicas utilizadas han sido las propias de la investigación documental: el análisis de contenido de naturaleza cualitativa, la observación document al, la lectura evaluativa, la técnica del resumen y fichas de trabajo. También se ha involucrado el análisis interno y externo de la bibliografía, el análisis jurídico de la información y el análisis progresivo, de donde han surgido las conclusiones y/o re comendaciones

    The purpose of this paper is to analyze how the phenomenon of authoritarian constitutionalism in Venezuela has been the mechanism of destruction of the Constitutional State, using for this purpose the very tools and institutions of the democratic system, a nd where the role of the constitutional jurisdiction, headed by the Constitutional Chamber of the Supreme Court of Justice has been decisive to carry it out. Thus, the research carried out shows that through manipulative and mutative interpretations of the Constitution, the Venezuelan constitutional judge has molded the content of the constitutional norms without modifying their text, under the pretended protection of exercising a so so-called normative jurisdiction and setting himself up as a positive legisla tor, trampling on the principle of separation of powers, as a fundamental pillar of the Constitutional State and usurping the exclusive functions of the Venezuelan Legislative Power. Methodologically, this work is inserted in the theoretical research modal ity, which offers the advantage of specifying empirical elements of the subject, complemented with a documentary review at a descriptive level, thus constituting an analytical research and conceptual development, supported by a broad bibliographical review . The originality of the study is reflected in the approach, criteria, conceptualizations, reflections, conclusions, recommendations and, in general, in the author's thinking. To this end, the techniques used were those typical of documentary research: qua litative content analysis, documentary observation, evaluative reading, the summary technique and worksheets. The internal and external analysis of the bibliography, the legal analysis of the information and the progressive analysis, from which the conclus ions and/or recommendations have arisen, have also been involved
