La Propuesta de Reglamento europeo por la que se establecen normas armonizadas en materia de inteligencia artificial (Artificial Intelligence Act) está llamado a tener un fuerte impacto en el mundo del trabajo. El presente trabajo se analizan sus más relevantes contenidos desde esa perspectiva. Particularmente relevante es: la definición del supraconcepto Inteligencia artificial y, en particular, de los modelos fundacionales. Igualmente, se subrayan los principios estructurales en los que se sustenta, la construcción basada en el riesgo y la diferenciación entre sistemas prohibidos y de alto riesgo, o, en fin, las obligaciones que contraen las empresas que implementen estos sistemas, así como el severo régimen sancionador que conlleva el incumplimiento del régimen de garantías previsto.
The Proposal for a European Regulation establishing harmonized rules on artificial intelligence (Artificial Intelligence Act) is set to have a strong impact on the world of work. This paper analyzes its most relevant contents from that perspective. Particularly relevant is: the definition of the Artificial Intelligence supra-concept and, in particular, of the foundational models. Likewise, the structural principles on which it is based, the risk-based construction and the differentiation between prohibited and high-risk systems, or, finally, the obligations assumed by the companies that implement these systems, as well as the severe sanctioning regime that entails the non-compliance with the foreseen system of guarantees, are underlined.
