El presente trabajo pretende analizar la inviolabilidad del rey en el sistema constitucional español. Para ello se tienen en cuenta perspectivas históricas, conceptuales y lingüísticas que tradicionalmente han sido ajenas al estudio de la prerrogativa. La doctrina ha mantenido que la inviolabilidad del jefe del Estado en España reconocida en el art. 56.3 CE era absoluta en lo material y temporal. Sin embargo, como consecuencia de los escándalos que han rodeado la última parte del reinado de Juan Carlos I, esta interpretación se ha visto ampliamente refutada y cuestionada. Se abordan los distintos enfoques teniendo en cuenta la jurisprudencia del Tribunal Constitucional y, por último, se consideran críticamente las distintas posibilidades de reformas legales o constitucionales.
The present work intends tu study the king´s inviolability in the Spanish constitutional system. For this, historical, conceptual and linguistic perspectives outside the study of the prerogative are considered. The Constitutional Law in Spain has maintained that the inviolability of the head of the State was absolute in temporal and substantive terms. However, as a consequence of the scandals that have surrounded the reign of Juan Carlos I, this interpretation has been widely refuted. The different approaches are analyzed taking into account the jurisprudence of the Constitutional Court. Finally, te possibilities of legal or constitutional reforms are critically considered.
