En el presente estudio se contraponen dos temas de gran actualidad, el ejercicio del poder de dirección y control de la parte empleadora y la protección de Derechos Fundamentales de la parte empleada, resultando que la labor de ingeniería jurídica en la interpretación que realiza nuestro Tribunal Supremo hace predominar el primero frente al segundo.

In this study, two very topical issues are contrasted, the exercise of the power of direction and control of the employer and the protection of Fundamental Rights of the employed party, resulting in the fact that the work of legal engineering in the interpretation carried out by our Supreme Court makes the first predominate over the second.
