Resumen de Derechos humanos en el consejo de Europa: Una aproximación desde las responsabilidades compartidas

En la evolución de los sistemas de protección de derechos humanos y, concretamente, en el del Consejo de Europa, es posible detectar ciertas tendencias o rasgos que adquieren sentido en el marco de una concepción cooperativa de los derechos humanos y de las instituciones encar-gadas de asegurar su efectividad. El propósito de este artículo es analizar cómo interpretan las responsabilidades estatales el Tribunal Europeo de Derechos Humanos y el Comité Europeo de Derechos sociales. Para llevar a cabo este examen, tendré en cuenta las decisiones de ambas instituciones ante las medidas estatales denominadas «anticrisis» o de austeridad. Se trata de un ámbito donde adquiere especial significación la interpretación de las categorías de obliga-ción y responsabilidad y que inciden en la jurisprudencia de ambos órganos ante otros procesos sociales posteriores.

The evolution of human rights systems protection and specifically in the Council of Europe, shows certain trends or features that become meaningful in the framework of a cooperative conception of human rights and of the institutions in charge of ensuring their effectiveness. The aim of this article is to analyze how state responsibilities are interpreted by the European Court of Human Rights and the European Committee of Social Rights. In order to carry out this examination, I will consider the decisions of both institutions in the face of so-called anti-crisis or austerity state measures. This is an area in which the interpretation of the categories of obli-gation and responsibility takes on particular significance and which affects the jurisprudence of both bodies in other subsequent social proces
