Resumen de Los "tiempos" de la Directiva (UE) 2019/1152: transparencia y lucha contra la precariedad laboral como objetivos

  El estudio analiza la Directiva (UE) 2019/1152 del Parlamento Europeo y del Consejo, de 20 de junio de 2019, relativa a unas condiciones laborales transparentes y previsibles en la Unión Europea que introduce importantes cambios en relación con su antecedente: la Directiva 91/533/CEE del Consejo, de 14 de octubre de 1991. La misma se destina, por un lado, a reforzar las garantías de una condiciones laborales cada vez más transparentes y, por otro, a definir un marco de condiciones laborales previsibles integrando instrumentos efectivos de lucha contra la precariedad laboral y, por extensión, que permitan enfrentarse con garantías a los cambios derivados del proceso de transformación digital en el que estamos inmersos. Aunque la misma se ha mostrado ambiciosa y, sin duda, mejora y perfecciona a su predecesora, lo cierto es que existen vacíos de regulación que necesitarán, a corto plazo, nuevas y contundentes respuestas.

  The study analyses Directive (EU) 2019/1152 of the European Parliament and of the Council of 20 June 2019, on transparent and predictable working conditions in the European Union, which introduces important changes in relation to its predecessor: Council Directive 91/533/EEC of 14 October 1991 on an employer's obligation to inform employees of the conditions applicable to the contract or employment relationship. The new regulation aims, on the one hand, to reinforce the assurances that favour transparency in the knowledge of their working conditions and, on the other hand, to define a set of instruments that are effective in the fight against job uncertainty and, by extension, that allow us to effectively face the changes derived from the process of digital transformation in which we are immersed. Although it is ambitious and undoubtedly improves and perfects its predecessor, the truth is that there are regulatory gaps that will require new and forceful responses in the short term.
