Resumen de A Propriedade Intelectual: do Direito Privado ao Bem Público

The importance of the debate around copyright ownership issues has increased since knowledge has become the engine of the new economy and its circulation in digital networks on a global scale has been intensified. The discussion is focused mainly in the question of encouragement to innovation: if, on one hand, the legislation that regulates this kind of rights has the protection of creative work and achievement as an aim, on the other hand it can generate a conflict between private privilege and public interests, where a balance between the two is to be desired. The free flux of information is important in all areas, but of the essence in science. Therefore, authors are lead to explore new ways for sharing information that complement the traditional ways followed up till now.

A transformação do conhecimento em motor da nova economia e a sua circulação pelas redes digitais de informação à escala global renovou o interesse pelas questões relativas à propriedade intelectual. A discussão centra-se, sobretudo, no problema da estimulação da inovação: se, por um lado, a legislação que governa esta propriedade tem como objectivo a protecção do trabalho criativo e do investimento realizado, pode, por outro lado, entrar em conflito entre o bem privado e o interesse público, não atingindo o equilíbrio necessário. O fluxo livre da informação é importante em qualquer sector, mas essencial na comunicação da ciência e é essa a razão que conduz os autores à exploração de novas vias para a partilha de informação que podem ser complementares aos processos tradicionais.
